Welcome to Kootami! These Terms & Conditions ("Terms") govern your access and use of the Kootami mobile application (the "App") and its associated services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
Kootami manages this platform and website. Throughout the site, the terms "we," "us," and "our" refer to Kootami. Kootami provides you, the user, with access to this platform, including all information, tools, and services available here, subject to your acceptance of all terms, conditions, policies, and notices stated in these Terms of Service ("Terms").
By accessing our platform and/or using our services, you engage with our "Service" and agree to abide by these Terms. These Terms of Service apply to all users, including but not limited to browsers, members, vendors, volunteers, and content creators.
Please read these Terms of Service carefully before accessing or using any part of the platform. By accessing or using any section, you acknowledge that you have read, understood, and agreed to these Terms of Service. If you do not agree with the terms, you may not access the platform or use the services. If these Terms are considered an offer, acceptance is explicitly limited to the terms outlined here.

Kootami reserves the right to update, modify, or replace any part of the Terms by posting changes to the platform. It is your responsibility to periodically check for updates. 2. Definitions
Organization: Refers to any association, community, trust, charity, syndicate, union, society, council, club, or any other similar entity registered on the App.
User: Refers to any individual who accesses or uses the App, whether as a member, organizer, vendor, or user.
3. Eligibility
By agreeing to these Terms of Service, you confirm that you are at least the legal age of majority in your state, province, or country of residence, or that you are of legal age and have granted us permission to allow your minor dependents to use this platform.
You may not use the platform for any unlawful or unauthorized purposes, including but not limited to violating any applicable laws in your jurisdiction (such as copyright or data protection laws).
The use of offensive, inappropriate, or foul language while interacting with the platform or its users is strictly prohibited.
4. Account Registration
User Accounts: To access certain features of the App, you may need to create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
Organization Accounts: Organizations must provide valid and accurate information during registration. Only authorized representatives may register on behalf of an organization..If unauthorized access is detected, the user’s access will be blocked unless ownership is transferred to the appropriate authorized person.
To maintain access to all features within your organization, Organization KYC document submission is mandatory within 90 days. A one-time extension may be granted upon request, but failure to comply will result in restricted access to organizational features.

6. Fundraise Guidelines:
Kootami allows both organizations and individual users to create fundraisers, empowering communities to achieve their goals. To ensure trust, transparency, and legal compliance, the following guidelines must be followed by all fundraisers, whether representing an organization or acting as a regular platform user.
Eligibility and Compliance
Organizations: Must be properly authorized and verified to create fundraisers on Kootami.
Individual Users: Users creating personal fundraises must ensure that the campaign complies with local laws and platform policies.
All fundraisers must follow applicable laws, including those governing charitable donations and crowdfunding.
Accurate Campaign Information
Creators must provide truthful and clear details about the campaign, including the purpose, beneficiaries, and how the funds will be used.
Regular updates must be shared to build transparency and maintain donor trust.
Review and Approval Process
Every fundraiser undergoes a mandatory review by Kootami’s team to ensure accuracy, transparency, and legal compliance.
Fundraise will only be approved and made live after all documentation is reviewed and verified.
Organizations: Must ensure that the funds are used strictly for the purpose stated in the campaign.
Individual Users: Personal fundraisers must allocate donations exactly as described. Any misuse of funds will result in suspension and possible legal action.
Direct Donation Transfers
All donations are transferred immediately to the respective organization’s or creator’s linked bank account. Kootami will not hold any amount.
Handling Donations and Refund Policy
All donations are non-refundable. It is the creator’s responsibility to address donor concerns directly if any issues arise.
If the campaign fails to achieve its purpose or needs to be paused, the creator must notify donors promptly and transparently.
Compliance and User Responsibility
Donors are responsible for ensuring that their donations comply with local laws and tax regulations. Kootami is not liable for providing tax advice or documentation.
Prohibited Activities
Fundraisers cannot involve illegal activities, discrimination, violence, or misleading information.
Fundraisers for gambling, political campaigns, or activities violating platform policies are strictly prohibited.
Privacy and Data Protection
Creators must respect the privacy of donors by only collecting necessary information and ensuring it is not shared without consent.
Kootami is committed to data privacy, and creators are required to follow the same standards.
Admin and Management Rights
Organizations: An authorized admin manages the campaign on behalf of the organization and has complete control over the fundraiser and its content.
Individual Users: Have full responsibility for managing their campaigns, responding to donor inquiries, and ensuring transparency

11. User Conduct
User Content: Any content you upload, post, or share within Kootami remains your responsibility. You must ensure it does not violate any third-party rights or applicable laws.
Prohibited Activities: You agree not to engage in harmful activities, including but not limited to spamming, harassment, infringing intellectual property rights, or spreading misinformation.

12. Content and Intellectual Property
User Content: Users retain ownership of the content they post on the App but grant Kootami a non-exclusive, royalty-free license to use, modify, and distribute such content.
Intellectual Property: All content, trademarks, and other intellectual property on the App are owned by Kootami or its licensors and are protected by applicable laws.
License: By using the app, Kootami grants you a non-exclusive, revocable license to use the platform for community management and other purposes.
13. Copyright, Trademarks, and Other Intellectual Property
All content and materials available on the Kootami app, website, and associated services (collectively referred to as “Platform Content”), including but not limited to trademarks, service marks, trade names, images, audio, text, software, and the overall design and "look and feel" of Kootami, are protected under copyright, trademark, and other intellectual property laws. This includes the Kootami™ name, logo, and related stylized designs, which are the exclusive property of Kootami.
You are prohibited from reproducing, distributing, displaying, transmitting, selling, or using any Platform Content without explicit written permission, except for legitimate use of the platform’s services through its publicly available interfaces. Users are not permitted to download, reproduce, republish, or retransmit content as stand-alone files, including images or similar media.
Any unauthorized use of Platform Content that could lead to consumer confusion or misrepresentation is strictly prohibited. Violation of these terms may result in suspension of services or further legal action.

Data Collection: Kootami collects and processes personal data in accordance with our Privacy Policy.
Data Sharing: Information may be shared with third parties only for the purposes outlined in our Privacy Policy or as required by law.

You agree that Kootami shall, under no circumstances, be held liable for any consequential, incidental, indirect, special, punitive, or other damages, including but not limited to loss of profits, business interruptions, data loss, or other damages arising from your use of or inability to use the platform, even if Kootami has been informed of the possibility of such damages.
In no event shall Kootami’s total liability, in connection with the platform or the services, exceed the aggregate amount of fees paid by the user for the relevant services. Additionally, Kootami shall not be liable for any indirect, incidental, punitive, or consequential damages, regardless of the cause.

We[Kootami] reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
18. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of India, regardless of conflict of law principles. By accessing or using Kootami’s services, you agree that any disputes, claims, or controversies arising out of or relating to the platform will be subject to the exclusive jurisdiction of the courts located in India.
Although Kootami operates as a global platform, accessible across various countries, users are responsible for complying with the local laws applicable in their respective regions when engaging with our services. In case of any conflict between Indian laws and local laws, users agree to adhere to the local laws to the extent required, without compromising Kootami’s rights and policies under Indian jurisdiction.
