Welcome to Kootami! These Terms & Conditions ("Terms") govern your access and use of the Kootami mobile application (the "App") and its associated services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

Kootami manages this platform and website. Throughout the site, the terms "we," "us," and "our" refer to Kootami. Kootami provides you, the user, with access to this platform, including all information, tools, and services available here, subject to your acceptance of all terms, conditions, policies, and notices stated in these Terms of Service ("Terms").

By accessing our platform and/or using our services, you engage with our "Service" and agree to abide by these Terms. These Terms of Service apply to all users, including but not limited to browsers, members, vendors, volunteers, and content creators.

Please read these Terms of Service carefully before accessing or using any part of the platform. By accessing or using any section, you acknowledge that you have read, understood, and agreed to these Terms of Service. If you do not agree with the terms, you may not access the platform or use the services. If these Terms are considered an offer, acceptance is explicitly limited to the terms outlined here.

Any new features or updates added to the platform will also be governed by these Terms of Service. You can review the most up-to-date version of the Terms at any time on this page. Kootami reserves the right to update, modify, or replace any part of the Terms by posting changes to the platform. It is your responsibility to periodically check for updates. Your continued use of the platform after any changes are posted constitutes your acceptance of those changes.

2. Definitions

Organization: Refers to any association, community, trust, charity, syndicate, union, society, council, club, or any other similar entity registered on the App.

User: Refers to any individual who accesses or uses the App, whether as a member, organizer, vendor, or user.

3. Eligibility

By agreeing to these Terms of Service, you confirm that you are at least the legal age of majority in your state, province, or country of residence, or that you are of legal age and have granted us permission to allow your minor dependents to use this platform.

You may not use the platform for any unlawful or unauthorized purposes, including but not limited to violating any applicable laws in your jurisdiction (such as copyright or data protection laws).

The use of offensive, inappropriate, or foul language while interacting with the platform or its users is strictly prohibited.

4. Account Registration

User Accounts: To access certain features of the App, you may need to create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Organization Accounts: Organizations must provide valid and accurate information during registration. Only authorized representatives may register on behalf of an organization..If unauthorized access is detected, the user’s access will be blocked unless ownership is transferred to the appropriate authorized person.

To maintain access to all features within your organization, Organization KYC document submission is mandatory within 90 days. A one-time extension may be granted upon request, but failure to comply will result in restricted access to organizational features.

5. Use of the App

• Joining an Organization:

  • Users can join organizations and participate in their activities.
  • Private organizations users can't join directly. Admin only sends invitations.
  • Users can join an organization with or without a membership number based on the organization’s policies.
  • Admin approval may or may not be required, as determined by the organization’s administrator.
  • Members can join and participate according to the specific policies set by each organization.

• Membership:

  • Users can join or subscribe to membership plans based on the organization’s policies.
  • Organization admins can define membership plans.
  • Before subscribing, users are encouraged to read the organization’s guidelines available on their website.
  • Proceed with caution and ensure that the membership aligns with your expectations and needs.
  • Subscription terms, renewal policies, and benefits may vary across organizations.

• Members & Committees:

  • Organizations can appoint admins to manage operations, including events, fundraisers, and members at the organization level.
  • Admins are granted control to oversee activities but have limited access to organization settings and bank accounts.
  • The organization creator holds full control over the organization, including managing settings, appointing or removing admins, and configuring bank accounts.

  Refer to the guidelines mentioned in Point 6 for more details.

• Events:

  Refer to the guidelines mentioned in Point 7 for more details.

• Organization Donations:

  • Direct Donations: Organizations like NGO or Charity can receive direct donations from users for operational needs or specific causes. To enable donations Organizations must submit Donation KYC documents.
  • Non-Refundable Donations: Once a donation is completed, it is non-refundable unless otherwise required by applicable laws.
  • Compliance & Documentation: Organizations must ensure compliance with local laws and provide proper documentation or receipts to donors.
  • Misuse of Funds: Kootami reserves the right to block organizations or users involved in unauthorized or fraudulent donation activities.

6. Fundraise Guidelines:

Kootami allows both organizations and individual users to create fundraisers, empowering communities to achieve their goals. To ensure trust, transparency, and legal compliance, the following guidelines must be followed by all fundraisers, whether representing an organization or acting as a regular platform user.

• Eligibility and Compliance

  Organizations: Must be properly authorized and verified to create fundraisers on Kootami.

  Individual Users: Users creating personal fundraises must ensure that the campaign complies with local laws and platform policies.

  All fundraisers must follow applicable laws, including those governing charitable donations and crowdfunding.

• Accurate Campaign Information

  Creators must provide truthful and clear details about the campaign, including the purpose, beneficiaries, and how the funds will be used.

  Regular updates must be shared to build transparency and maintain donor trust.

• Review and Approval Process

  Every fundraiser undergoes a mandatory review by Kootami’s team to ensure accuracy, transparency, and legal compliance.

  Fundraise will only be approved and made live after all documentation is reviewed and verified.

  Organizations: Must ensure that the funds are used strictly for the purpose stated in the campaign.

  Individual Users: Personal fundraisers must allocate donations exactly as described. Any misuse of funds will result in suspension and possible legal action.

• Direct Donation Transfers

  All donations are transferred immediately to the respective organization’s or creator’s linked bank account. Kootami will not hold any amount.

• Handling Donations and Refund Policy

  All donations are non-refundable. It is the creator’s responsibility to address donor concerns directly if any issues arise.

  If the campaign fails to achieve its purpose or needs to be paused, the creator must notify donors promptly and transparently.

• Compliance and User Responsibility

  Donors are responsible for ensuring that their donations comply with local laws and tax regulations. Kootami is not liable for providing tax advice or documentation.

• Prohibited Activities

  Fundraisers cannot involve illegal activities, discrimination, violence, or misleading information.

  Fundraisers for gambling, political campaigns, or activities violating platform policies are strictly prohibited.

• Privacy and Data Protection

  Creators must respect the privacy of donors by only collecting necessary information and ensuring it is not shared without consent.

  Kootami is committed to data privacy, and creators are required to follow the same standards.

• Admin and Management Rights

  Organizations: An authorized admin manages the campaign on behalf of the organization and has complete control over the fundraiser and its content.

  Individual Users: Have full responsibility for managing their campaigns, responding to donor inquiries, and ensuring transparency

• Kootami’s Role and Liability

  • Kootami serves as a platform provider and is not responsible for the success or failure of campaigns.
  • Any disputes or concerns must be addressed between the creator and donors. Kootami will intervene only if there is a violation of platform policies.
  • By creating a fundraiser on Kootami, you agree to follow these guidelines. Failure to comply may result in campaign suspension, account termination, or legal action.

7. Event Guidelines:

All organizers using the Kootami platform must adhere to the following guidelines to ensure smooth operations and a positive experience for all participants.

• Compliance with Laws and Regulations

  • Organizers must ensure that events comply with all local, regional, and national laws and regulations.
  • Any required permits or licenses must be obtained prior to the event.

Approval Process

• Every event undergoes a mandatory review by Kootami’s team to ensure it aligns with platform policies and legal compliance.
• Events will only be approved and made live after all relevant documentation is submitted and verified by Kootami’s review team.

• Accurate Event Information

  • Organizers must provide clear and accurate details about the event, including date, time, location, pricing, and any terms related to participation or refunds.
  • Any changes to the event must be promptly communicated to participants through the platform.

• Refund and Cancellation Policy

  • Organizers are responsible for defining and managing refunds in the event of cancellations or changes.
  • Participants must be notified of cancellations or significant changes at the earliest opportunity.

• Safety and Security

  • Organizers must ensure a safe and secure environment for participants, following necessary health and safety protocols.
  • Emergency procedures and relevant contact details should be available during the event

• Prohibited Content and Conduct

  • Events promoting illegal activities, violence, hate speech, or discrimination of any kind are strictly prohibited.
  • Organizers must maintain a respectful and inclusive atmosphere for all attendees.

• Communication with Participants

  • Organizers are responsible for responding to participant queries and ensuring clear communication throughout the event lifecycle.

• Responsibility for Event Execution

  • Kootami acts only as a platform provider. The organizer is fully responsible for managing, executing, and delivering the event as advertised.

• Data Privacy and Confidentiality

  • Organizers must respect participants' data privacy and avoid sharing personal information with third parties without consent.

8. Event Cancellation & Refund:

Kootami serves as a platform provider, connecting organizers and participants for various events. Please review our cancellation policy carefully:

• Event Cancellation Responsibility:

  • Kootami is not responsible for the cancellation of any events hosted by organizers.
  • All event-related decisions, including cancellations, are at the discretion of the event organizer.
  • Any changes to the event, including cancellations and refunds, must be managed offline by the event creator.

• Refund Process:

  • In the event of a cancellation, the organizer is responsible for refunding the participants.
  • Kootami does not manage or process refunds for any events listed on the platform.

• Participant Communication:

  • Participants must contact the event organizer directly for any inquiries regarding cancellations, refunds, or rescheduling.
  • The organizer’s contact information will be available within the event details section on the Kootami platform.

• Platform Disclaimer:

  • Kootami operates only as a facilitator platform and holds no liability for financial transactions, cancellations, or changes made by event organizers.

9. KYC Documents:

By participating in the Kootami platform, you agree to adhere to these KYC requirements and understand that failure to comply may result in restrictions on your ability to post events, fundraise, or make donations.

• Organization KYC: Verification of the organization's identity is required to post events and initiate fundraising activities.
• Donation KYC: Organizations must submit country-specific documents, such as NGO or charity registrations, to enable donations. Compliance with local regulations is mandatory. Required documents may vary based on the organization's type and location. Kootami ensures donations are only activated after successful KYC and verification.
• Bank KYC:
  • Users must complete the Bank KYC to post Events and Fundraise.
  • Organization must complete the Bank KYC to post Events, Fundraise and to enable Donations.
• All KYC processes must comply with country-specific regulations.
• It is the responsibility of both the organization and users to periodically upload updated documents; expired documents should be replaced without delay.
• Kootami reserves the right to reject any documents that do not meet our standards or are deemed inadequate. All submitted documents will undergo verification by our team.

10. Fees and Payments

• Service Fees & Charges:

  • Kootami may charge a platform fee for certain services, including fundraising, events, Organization donations and vendor listings.
  • All transactions are subject to applicable convenience fees (platform fee, payment gateway charges, and applicable taxes such as GST).

• Payment Processing:

  • Kootami uses third-party payment gateways for secure transactions. Once the payment is processed, it is considered final, and Kootami does not hold or store any funds on behalf of users.
  • Any currency conversion charges or international transaction fees will be borne by the donor or payer.

• Payouts for Memberships/Donations/Event Registrations:

  • After deducting applicable convenience fees, the remaining payment amount will be directly transferred to the verified bank account provided by the fundraiser or event creator or organization.
  • Payouts will be initiated according to the schedule determined by the payment gateway and local banking regulations

• User Responsibilities:

  • Users agree to provide accurate payment and bank details. Kootami is not liable for delays or failures caused by incorrect or incomplete information.
  • Users are responsible for compliance with local laws related to financial transactions, including tax obligations and regulatory filings.

11. User Conduct

User Content: Any content you upload, post, or share within Kootami remains your responsibility. You must ensure it does not violate any third-party rights or applicable laws.

Prohibited Activities: You agree not to engage in harmful activities, including but not limited to spamming, harassment, infringing intellectual property rights, or spreading misinformation.

Platform Ethics:

• Kootami is strictly non-political and does not endorse or support any political party, ideology, or agenda.
• Kootami upholds respect for all religions, cultures, and communities. The platform prohibits discriminatory or offensive content and does not promote any specific religion or caste.
• Kootami is committed to facilitating positive community engagement and must be used solely for managing organizational activities and initiatives.

12. Content and Intellectual Property

User Content: Users retain ownership of the content they post on the App but grant Kootami a non-exclusive, royalty-free license to use, modify, and distribute such content.

Intellectual Property: All content, trademarks, and other intellectual property on the App are owned by Kootami or its licensors and are protected by applicable laws.

License: By using the app, Kootami grants you a non-exclusive, revocable license to use the platform for community management and other purposes.

13. Copyright, Trademarks, and Other Intellectual Property

All content and materials available on the Kootami app, website, and associated services (collectively referred to as “Platform Content”), including but not limited to trademarks, service marks, trade names, images, audio, text, software, and the overall design and "look and feel" of Kootami, are protected under copyright, trademark, and other intellectual property laws. This includes the Kootami™ name, logo, and related stylized designs, which are the exclusive property of Kootami.

You are prohibited from reproducing, distributing, displaying, transmitting, selling, or using any Platform Content without explicit written permission, except for legitimate use of the platform’s services through its publicly available interfaces. Users are not permitted to download, reproduce, republish, or retransmit content as stand-alone files, including images or similar media.

Any unauthorized use of Platform Content that could lead to consumer confusion or misrepresentation is strictly prohibited. Violation of these terms may result in suspension of services or further legal action.

14. Privacy

Data Collection: Kootami collects and processes personal data in accordance with our Privacy Policy.

Data Sharing: Information may be shared with third parties only for the purposes outlined in our Privacy Policy or as required by law.

15. Termination

• These Terms of Use shall remain in effect as long as you continue to use the Kootami platform. You may delete your account at any time, for any reason, by following the instructions provided on the platform. However, Kootami does not offer any refunds upon account deletion.
• Kootami reserves the right to suspend or terminate services, or shut down the platform, at its sole discretion without prior notice. Your account or access to the platform may be terminated immediately, with or without notice, and without liability, if Kootami determines that you have violated these Terms, the Privacy Policy, provided false or misleading information, or disrupted the use of the platform by others.
• Kootami also reserves the right to cancel, delete, or deactivate your account if it believes the account has been compromised or is being used fraudulently, at its sole discretion.

16. Limitation of Liability

You agree that Kootami shall, under no circumstances, be held liable for any consequential, incidental, indirect, special, punitive, or other damages, including but not limited to loss of profits, business interruptions, data loss, or other damages arising from your use of or inability to use the platform, even if Kootami has been informed of the possibility of such damages.

In no event shall Kootami’s total liability, in connection with the platform or the services, exceed the aggregate amount of fees paid by the user for the relevant services. Additionally, Kootami shall not be liable for any indirect, incidental, punitive, or consequential damages, regardless of the cause.

17. Changes to Terms

We[Kootami] reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

18. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, regardless of conflict of law principles. By accessing or using Kootami’s services, you agree that any disputes, claims, or controversies arising out of or relating to the platform will be subject to the exclusive jurisdiction of the courts located in India.

Although Kootami operates as a global platform, accessible across various countries, users are responsible for complying with the local laws applicable in their respective regions when engaging with our services. In case of any conflict between Indian laws and local laws, users agree to adhere to the local laws to the extent required, without compromising Kootami’s rights and policies under Indian jurisdiction.
